Third-country nationals: what permits needed?

At first, it shall be noted that in the event of a longer stay in Hungary, a residence permit must be requested for the concerned third-country nationals, and certain residence permit types also entitle the eligible persons to work, without any additional permits.

The permit types providing the opportunity to work at the same time are the followings. Please also note that the below is not an exhaustive list, but these permits do arise most often in practice.

  1. residence permit for employment purposes,
  2. residence permit for intra-company transfer,
  3. residence permit for study purposes,
  4. residence permit for family reunification purposes,
  5. EU blue card.

In the case of such permit types, it should be emphasized that not only the conditions of employment (employer, amount of working hours, etc.) differ, but also the conditions, documents required for applying for the permit, and the procedure itself as well. We shall revert to and provide overview information pertaining to the detailed rules of each type of residence permit in separate blog posts.

However, it can be stated in general that the most suitable type of permit in a specific case can be determined by knowing the unique circumstances of the case. In this context, it is necessary to consider several aspects, so the following can all influence the selection of the appropriate permit type:

  • the primary purpose of the permit (so that it actually primarily refers to employment or, for example, continuing studies),
  • the employer's needs (including, for example, the amount of working time expected in the employment relationship),
  • the labour policy practice of the authority (thus the most effective determination of the specific position, working conditions etc.), and
  • the personal circumstances of the prospective employee.
